Ethics & Legal

With great power comes great responsibility. Using AI in real estate means navigating compliance, privacy, and ethical considerations. Get this wrong, and it can cost you your license. Get it right, and you build trust that sets you apart.

Know the Rules

Compliance & Fair Housing

⚖️ Fair Housing & AI

AI tools can inadvertently generate content that violates fair housing laws. Language models reflect patterns in their training data — which can include biased descriptions, steering language, or discriminatory phrasing.

  • Always review AI-generated listing descriptions for language that references protected classes (race, religion, familial status, etc.)
  • Never use AI to target or exclude specific demographics in advertising
  • Avoid neighborhood descriptions that could be interpreted as steering
  • Check your board's guidelines — some have specific rules about AI-generated content

📝 RECO & Regulatory Bodies

Stay updated on your provincial/state regulatory body's position on AI. In Ontario, RECO (Real Estate Council of Ontario) has been evolving its guidance. Key principles: you are responsible for all content you publish, regardless of how it was generated. AI-generated ≠ AI-responsible. You are always the accountable party.

Protect Your Clients

Privacy & Disclosure

🔒 Data Privacy Best Practices

  • 1.Never paste client personal data into public AI tools. Names, addresses, financial info, and personal details should not go into ChatGPT or similar services.
  • 2.Use enterprise/team plans when possible. They often have better data handling policies and don't train on your inputs.
  • 3.Anonymize before analyzing. If you need AI to review a contract, strip out names, addresses, and identifying info first.
  • 4.Disclose AI usage when appropriate. If a client asks how you created something, be transparent. Trust is your most valuable asset.

🏆 The Golden Rule of AI in Real Estate

Use AI to enhance your expertise, not to fake it. AI should make you faster, smarter, and more helpful — but never replace your judgment, your fiduciary duty, or your genuine care for clients. The best agents use AI as a superpower, not a shortcut.
